Terms of Use
The terms that govern orders and use of OvernightBanner.com. Effective November 8, 2026.
1. Acceptance of Terms
These Terms of Use govern all access to and use of OvernightBanner.com, operated by Lexington Sign & Graphics LLC ("Overnight Banner," "we," "us," or "our"). By using this website or placing an order, you agree to be bound by these terms, our Privacy Policy, and any additional guidelines posted on the site. We may update these terms at any time. Continued use of the site after an update means you accept the revised terms.
2. Order Acceptance
All orders are subject to acceptance by Overnight Banner. We may refuse or cancel any order at our discretion, including orders that appear fraudulent, contain prohibited content, or cannot be fulfilled for any reason. Submitting an order is an offer to purchase; a binding contract is formed only when we accept and confirm your order.
We may adjust pricing at any time. If there is a pricing error, we will contact you before processing your order.
3. Custom Artwork & Intellectual Property
By submitting artwork, logos, images, or other content, you represent and warrant that:
- You own or have the legal right to use and reproduce all submitted content
- Your content does not infringe any third-party copyright, trademark, patent, trade secret, or other intellectual property right
- Your content does not contain defamatory, obscene, illegal, or otherwise objectionable material
Overnight Banner assumes no responsibility for claims arising from customer-submitted artwork. You agree to indemnify and hold us harmless from any claims, damages, or expenses (including attorney's fees) arising from your submitted content.
4. Production & Shipping
Orders are typically produced the next business day and shipped via FedEx Priority Overnight at no additional charge. Same-day production is available for orders placed before 1:00 PM Eastern Time, subject to availability and the rush fee shown at checkout. Custom t-shirts take 3 to 5 business days to print before they ship.
Shipping terms are F.O.B. origin. Once your order has been handed to the carrier, Overnight Banner is not responsible for delays, loss, or damage caused by the carrier. Delivery estimates are not guaranteed. We are not liable for losses caused by carrier delays, weather, natural disasters, governmental actions, or other circumstances beyond our control.
Shipping address. You are responsible for a complete and accurate shipping address, including any suite, unit, or building number. We are not responsible for orders that are delayed, misdelivered, or returned because of an incorrect or incomplete address. Carrier address-correction or reshipping charges caused by an incorrect address will be billed to you. If you notice an error, contact us right away; we will do our best to update it before your order ships, but cannot guarantee changes once it is with the carrier.
5. Returns & Defect Claims
Because every product is custom-printed to your specifications, we do not accept returns or exchanges. All sales are final once an order has entered production.
If you receive a product that was produced incorrectly because of our error (for example wrong size, wrong product, or a printing defect), you must notify us in writing within 48 hours of delivery. Claims after this window may not be eligible. Replacement is available only for orders produced in error and returned in their original condition. Orders showing signs of use, damage, or alteration are not eligible.
We are not responsible for errors in customer-submitted artwork, including spelling, grammar, color choices, resolution, or layout. Please proof your design carefully before approving it.
6. Payment
Payment is due at the time of order. We accept major credit and debit cards. If your payment is declined, your order will not be processed. For any overdue balances, a monthly finance charge of 2% (annual percentage rate of 24%) may be applied to the unpaid balance. You agree to cover all reasonable collection costs, including attorney's fees, if legal action is required to collect a delinquent account.
7. Warranty Disclaimer
Overnight Banner makes no express warranties regarding its products beyond what is stated in these terms. All products are provided "as is." Our sole obligation for a qualifying defect is, at our discretion, replacement of the defective product or a store credit. We do not offer cash refunds for defective items.
8. Limitation of Liability
To the fullest extent permitted by law, Overnight Banner and Lexington Sign & Graphics LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, products, or services, including lost profits, lost revenue, or costs of substitute goods, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from a product or order shall not exceed the amount you paid for that specific order.
9. Cancellations & Refunds
Orders may be cancelled without charge before they enter production. Once production has begun, no cancellation or refund is available. If your order has already shipped, no refund will be issued. Please contact us as soon as possible if you need to cancel.
10. Prohibited Content
You may not use OvernightBanner.com to produce products containing:
- Content that infringes any copyright, trademark, or other intellectual property right
- Defamatory, harassing, threatening, or hateful content
- Obscene, pornographic, or sexually explicit content
- Content that promotes illegal activity
- Content that violates any applicable federal, state, or local law
We may refuse production of any order containing prohibited content at our sole discretion.
11. Governing Law & Dispute Resolution
These Terms of Use are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict of law principles. Any dispute arising from these terms or your use of our services is subject to the exclusive jurisdiction of the state and federal courts located in Fayette County, Kentucky. You consent to personal jurisdiction in those courts.
12. Changes to These Terms
We may modify these Terms of Use at any time. Updated terms will be posted on this page with a revised effective date. Continued use of our website or services after a change means you accept the updated terms.
